Release
of Garnishment or Levy
The
unique power of the IRS allows it to operate without judicial due
process. In other words, it doesn't have to go to court to levy on
your bank account or garnish your paycheck. It can accomplish
administratively what everyone else must attempt judicially.
While
you may not get your day in court to prevent a garnishment or levy,
it's usually not the Service's first tool of choice. If you feel
that one of these steps is looming, consult a tax attorney. Wage
levies and bank account levies can sometimes be prevented or lifted
through negotiation with the IRS.
